THE PARALLEL LAW

Abstract

The author of article considers that in Russia there was «a parallel law». Judiciary practice which substitutes for itself action of imperative rules of law concerns «the parallel law» and contradicts them. This judiciary practice hasn't something in common with literal interpretation of imperative norm. As a result courts are guided not by literal interpretation of the imperative norm, but by the judiciary practice. The author considers that this very dangerous legal phenomenon and suggests to develop scientific discussion about this problem. The author offers how to try to put under control «the parallel law».
