THE FORMS OF REALIZATION OF TRADITIONAL LAW IDEAS OF THE RUSSIANS IN THE LEGAL ACTS OF THE PERIOD OF THE SOVIET STATE FORMATION

Abstract

In the article the author studies well-known acts of law adopted in the first months of the Soviet power formation. The way of the study though is unusual. The author analyses the norms of the first Bolshevik decrees with respect to their correspondence to law ideas of the people. The article shows how the change of direction of law policy from populist to state-oriented transformed the contents of acts of law regulating different spheres of social life. The author proves that the variety of the law policy in the first months of the Soviet power is conditioned not only by the absence of certain ideas about the state-legal development of the country, but also by the reflectionof the crisis of the public conscience and the destruction of the traditional-communal law values.
