SUBJECTS OF NATURAL MONOPOLIES IN THE CONDITIONS OF COMPETITIVE ECONOMY: RESTRICTIONS LEGITIMACY CRITERIA OF THE CONSTITUTIONAL FREEDOM OF BUSINESS

Abstract

Тhe characteristic of legal status of subjects of natural monopolies in the Russian Federation is given in the article. Research of restrictions legitimacy of constitutional rights of the economic entities which are carrying out business activity in the form of natural monopoly in the conditions of competitive economy is performed. Classification and the analysis ratio criteria restrictions, which were developed by scientists-constitutionalists and legal positions of the constitutional Court of the Russian Federation, in the context of the principles for preventing excessive restrictions is carried out: achievement of general welfare, principles of justice, commensuration, proportionality.
