THE ISSUE OF CONTENT SPECIFIC KNOWLEDGE WHEN DETERMINING THE PROCEDURAL STATUS OF THE EXPERT AND SPECIALIST

Abstract

The relevance of the article due to the importance of the use of expertise (knowledge) in Russian legal proceedings. The purpose of this article is to analyze the concept of "expert", "specialist", "special knowledge", "special knowledge" to identify and consider the theoretical and applied features of the special knowledge (knowledge) experts and specialist contained in Russian legislation, judicial practice and science. Realizacije of tasks was achieved with the help of General scientific (dialectic, analysis, synthesis) and private-scientific methods (formal-legal, comparative-legal). The authors conclude that in determining the procedural status of the expert and the expert should not accept special knowledge (cognition) as such, and the professionalism of the person expressed in his jurisdiction.
