Abstract

The article dwells upon consideration of the practical issues arising when a labor contract termination in case of liquidation of the organization and termination of activities of entrepreneur. The article clarifies conditions whereby termination of a labor contract in such case shall be lawful, attention is paid to the distribution of the burden of proof in court proceedings of dismissal disputesparagraph under 1 part 1 of Article 81 of the Labor Code of the Russian Federation. The conclusion of the article is that a labor contract may be terminated before ending liquidation of the organization and termination of activities of entrepreneur, list of ways of the notice of the employee on the forthcoming dismissal and conditions of legality of each of these ways is offered.
