DEVELOPMENT OF MEDIATION IN GERMANY AS A SOCIAL AND LEGAL INSTITUTION

Abstract

The article is given the analyzes the development of mediation as a way of alternative dispute resolution in Germany from the 80-s of the XXth century. The author considers such processes, which testify to the establishment of mediation in Germany as a social and legal institution, as the formation of the practice of mediation, creation of organizational and information conditions for its dissemination, holding conferences and other scientific events aimed at studying and creating a culture of conflict resolution, state support measures being taken. An analysis of the normative regulation of mediation in Germany was conducted with a view to determining its legal nature and the quality of the legal category set limits in the legislative regulation of the procedure for mediation in Germany and the requirements for the procedure and the mediator.
