Abstract

On the basis of the analysis of the evolution of the scientific views, based on the consensus of contemporary knowledge and relevant international norms and principles of the author substantiates one of the guiding principles of action of states in the area of limitation and control of merchant shipping, in the framework of the implementation of the provisions of security council of the UN in peace-time, outside of armed conflict is the principle of without reference to nationality of the ship.
