THE RENT OF AN OFFICIAL DWELLING AND ITS PLACE IN THE SYSTEM OF CONTRACTS OF RENT

Abstract

With enactment of the Housing Code of Russian Federation in 2004 the classification of the residential premises unlike the former legislation provides two touchstones for separating the housing fond in Russian Federation into several composite parts. Alongside with historically established and generally accepted criteria the property form the legislator used the second criteria the purpose of the housing exploitation. Among others the specialized residential premises fond which comprehends the official housing premises is separated in the Housing Code. This article is an attempt to prove the necessity for separating of the official residential estates into the independent fond alongside with the fond of social exploitation, individual housing fond and the housing fond for commercial use.
