The applicant indicates that upon registration of cell cultures in the collections, carrying out the deposition for the purposes of patent procedure, it is necessary to conduct compulsory checks on their identity to the strains already existing in collectable funds. The introduction of this requirement will reduce the risk of re-deposition samples with new numbers and names, which could significantly affect the evaluation criteria of novelty required for a patentable invention. Special attention is paid to the conditions with which the legislator connects the need to provide documents proving the Deposit of biotechnological material. In the opinion of the applicant, is necessary to clarify that the industrial applicability must be confirmed by the document on the Deposit in respect of microbial strains and cell lines of plants, animals unknown in the art, and are not publicly available for professionals in this field.Downloads
