PROBLEMS OF APPLICATION TO PERSONS WITH MENTAL CHANGES COERCIVE MEASURE AS CONFISCATION OF PROPERTY

Abstract

In the article the author researched the question of the relevance of confiscation to the property of persons who have a variety of deviations from norm of the mental state of the individual. This question is investigated by categories of persons with mental changes, which modern criminal legislation distinguishes taking into account the diversity of mental illness, in relation to property of persons who committed a crime and suffering mental disorders not excluding sanity, deranged subjects, persons, who after the crime occurred a mental disorder that makes it impossible to appoint or execution of punishment.
