GOVERNMENT COERCION TO PERSONS WITH MENTAL ILLNESS (CRIMINAL AND CRIMINAL PROCEDURE ASPECTS)

Abstract

The phenomenon of state coercion in criminal law and criminal procedural relations on the example of its application to certain categories of subjects subjects with mental disorders is analyzed by the authors of the article. The features of the state criminal and criminal-procedural coercion to persons with mental illness are shown on the analysis of the elements of coercion (subjects, objects of coercion, reason, terms, the purposes of the application of coercion, the specific enforcement measures). It is revealed that the criminal (the criminal) the state compulsion against persons with mental disorders has specific symptoms, caused by the presence in the recipients of the coercion of the diseases of the mind.
