VERIFICATION OF LAWS OF SUBJECTS OF THE RUSSIAN FEDERATION ON COMPLIANCE WITH THE CONSTITUTION OF THE RUSSIAN FEDERATION: A COMBINATION OF ABSTRACT AND CONCRETE CONTROL OF NORMS

Abstract

On the basis of the analysis of the features of abstract and specific norm control, the article analyzes the specifics of the implementation of these forms of constitutional norm-control in the sphere of regional legislation. Justifying the inadmissibility of substituting one type of norm control for others, proposals are made for their improvement. In the part of abstract normative control, proposals are made to expand the possibilities for constitutional review of regional laws, for example, by involving a constitutional law and federal law, on the basis of which the law of the subject of the Russian Federation was adopted. Of particular importance is the improvement of the institution of the constitutional complaint; so, it is important to provide an opportunity to resort to a specific normative control in cases when the constitutional rights of a citizen are violated not only by law, but also by certain by-laws of the subjects of the Russian Federation. But such an appeal to constitutional justice is possible only if the restoration of violated constitutional rights is impossible otherwise.
