THEORETICAL PROBLEMS OF INTEGRATIVE RIGHT UNDERSTANDING

Abstract

The article continues the study of theoretical problems related to the analysis of the leading concepts of integrative legal understanding in Russia. The author focuses on the theoretical difficulties that have developed in the ancient tradition and scholasticism, as well as the problem of deconstruction of elements of social reality as part of the interpretative scheme of knowledge of the nature of law in the framework of the unfinished project of integrativists on the example of the concept of B. A. Kistyakovsky. The scientific literature devoted to the study of the problems of legal reality is analyzed, and the conclusion is made about the influence of changes in the theory of knowledge long before the development of the theoretical direction under study on the perception of the integrative understanding of law.
