THE ESSENCE OF THE EXCLUSIVE RIGHT TO COPYRIGHTED WORKS

Abstract

The article is devoted to research of the essence of the exclusive right. The paper analyzes the evolution of scientific approaches to understanding the rights to the results of intellectual activity from proprietary theory to the concept of exclusive law. On the basis of a comparison of property and exclusive rights, determining the place of exclusive rights in the civil rights system, the author has formulated distinctive features of exclusive rights. In conclusion, the conclusion is made about the nature of the impact of scientific and technological progress on the commercial use of intellectual property and highlights the main directions for the further development of the concept of exclusive rights.
