THE CONCEPT OF "PROPERTY" IN THE EURASIAN LEGAL CONCEPT BY N.N. ALEKSEEV

Abstract

The article is devoted to one of the key problems of legal science, which has occupied lawyers for more than a century, namely the definition of the essence of the concept of “property” and the features of its legal manifestations. On the basis of the methods of philosophy of law, the work analyzes the Eurasian legal concept of property, reveals its basic provisions, conclusions that have modern significance. The authors prove that N.N. Alekseev as a representative of the legal direction of Eurasianism managed to significantly increase scientific knowledge about the influence of ideas of ownership prevailing in society on the type of socialization, the structure and classification of property rights, the role of private property in the formation of public order. Based on the study, the authors proposed directions for the development of the legal concept of ownership at the present stage of development of legal science.
