DISPUTED ISSUES OF SUCCESSION IN THE CIVIL PROCESS

Abstract

Based on the materials of judicial practice, the article highlights some controversial issues, as well as theoretical and practical problems of applying procedural legislation regulating issues of succession in civil cases in courts of General jurisdiction, in arbitration courts. The article analyzes the legal nature of the procedural succession, the reasons for its occurrence in civil and arbitration proceedings, and the features of the procedural succession when the courts consider cases related to the implementation of the rights to receive social benefits by the heirs, to which the testator was entitled during his lifetime, but which were not transferred to him during his lifetime.
