STABILITY OF THE JUDGMENT AS AN ILLUSION OF ITS LEGALITY

Abstract

The article examines the principle of stability of a judicial decision in the context of the legality of the principle itself and the legality of its establishment as a priority of judicial law enforcement practice. The author comes to the conclusion that the principle of stability of a judicial act only creates the appearance of its legality. Moreover, not enshrined in law, the principle of stability of a judicial act elevated to absolute leads to massive violations of the constitutional rights of citizens.
