Abstract

The article is devoted to the actual problem of criminal parental violence. The media is replete with descriptions of high-profile cases of child abuse. Based on the study of official statistics on the practice of sentencing for a crime under article 156 of the criminal code of the Russian Federation "Failure to perform duties for the upbringing of a minor", the authors conclude that this crime is unjustifiably liberal. In this regard, the article proposes to return such a specific measure of civil liability as deprivation of parental rights to the status of a special type of additional criminal punishment. Taking into account the social and human importance of the problem of parental violence in the scientific revolution prompted and handled separately in the statistical forms to monitor the condition of the problem, the category of "parent of crime", under which, by analogy with the legislative definition of crimes of an extremist orientation (note 2 to article 2821 of the criminal code), the authors understand the crimes of the parents is directly contained by articles of the Special part of the criminal code and paragraph "p" of part 1 of article 63 of the criminal code.
